PUTRAJAYA: The Federal Court has struck out former Langkawi Wanita Umno member Ainina Saadudin’s bid to reinstate her tort of misfeasance lawsuit against Prime Minister Datuk Seri Najib Razak in reference to 1Malaysia Development Bhd (1MDB).
The three-member panel of judges led by Chief Justice Tun Raus Sharif struck out her application for leave to appeal and also allowed her lawyer Irzan Iswad to discharge himself from representing her.
Irzan said the cause paper was handed to Ainina, who was not present in court, on March 5.
“We were informed that the applicant (Ainina) did not object to our request to discharge ourselves from representing her,” he told the court.
Former prime minister Tun Dr Mahathir Mohamad, former Batu Kawan Umno vice-chief Khairuddin and Ainina sued Najib on March 23, 2016, accusing him of having committed misfeasance in public office and acting in breach of his fiduciary duty over the management of 1MDB.
On April 28 last year, the High Court allowed Najib's application to strike out the suit, ruling that the prime minister was not a public official but a member of the administration.
On Aug 30, last year, the Court of Appeal dismissed the appeal brought by Dr Mahathir, Khairuddin and Ainina.
Dr Mahathir and Khairuddin had their application for leave to appeal dismissed on Feb 27 this year by a three-member panel of the Federal Court, also led by Raus.
Sitting in with Raus on the panel today were Federal Court judges Datuk Seri Balia Yusof Wahi and Tan Sri Aziah Ali.
